By accessing or using AirsoftMarket.ca (“the Platform”), you agree to be bound by these Terms of Use and all applicable Canadian laws and regulations.
If you do not agree, please discontinue use immediately. These terms apply to all users, including browsers, buyers, sellers, and content contributors.
- Account Registration
2.1 Eligibility
You must be 18 years or older to create an account. By registering, you confirm that you meet this requirement and have the legal capacity to enter into binding agreements.
2.2 Account Security
- You are responsible for maintaining the confidentiality of your login credentials.
- Notify us immediately of any unauthorized use or breach.
- You are responsible for all activity occurring under your account.
- AirsoftMarket.ca may suspend or terminate accounts that violate these Terms or community guidelines.
- User Conduct
3.1 Prohibited Activities
You agree not to:
- Post false, misleading, or fraudulent listings.
- Sell prohibited, illegal, or stolen goods.
- Infringe on intellectual-property or privacy rights.
- Harass, threaten, or abuse other users.
- Manipulate ratings, feedback, or search results.
- Circumvent bans or verification processes.
- Use bots, scrapers, or automated tools to harvest data.
- Interfere with the operation, performance, or security of the Platform.
3.2 Prohibited Items
You may not list or trade:
- Real firearms, ammunition, explosives, or prohibited weapons.
- Items violating Canadian import/export laws.
- Counterfeit or trademark-infringing products.
- Illegal drugs or controlled substances.
- Stolen property.
- Adult or obscene material.
- Live animals, human remains, or body parts.
- Items subject to manufacturer recall or that pose safety hazards.
Replica airsoft items must comply with Canadian federal, provincial, and municipal laws, including FPS/energy thresholds and visual marking requirements where applicable.
- Listings and Content
4.1 Listing Requirements
- Listings must accurately describe the item being offered.
- Images must represent the actual item; stock photos must be clearly labeled as such.
- Prices must be transparent and include all applicable fees.
- You retain ownership of your listing content but grant AirsoftMarket.ca a non-exclusive, worldwide, royalty-free license to display and distribute it on the Platform.
4.2 Moderation
Listings are subject to review and may be edited, hidden, or removed at our discretion if they violate these Terms or applicable law. Repeated violations may result in account suspension or permanent removal.
- Transactions and Payments
5.1 Peer-to-Peer Transactions
AirsoftMarket.ca is a classifieds platform, not a payment intermediary or escrow service.
Transactions occur directly between buyers and sellers.
We do not handle payments, shipping, or delivery. Users are solely responsible for verifying listings and completing transactions safely.
5.2 Payment Safety
Use only traceable, reversible payment methods (e.g., PayPal Goods & Services, Interac e-Transfer to known contacts). Avoid wire transfers, crypto, or cash-by-mail.
AirsoftMarket.ca does not provide payment protection or refunds.
- Fees and Membership
6.1 Service Fees
Certain optional features may require payment, including:
- Premium or business membership plans.
- Featured or promoted listings.
- Enhanced business analytics or advertising.
Fees are clearly disclosed prior to purchase.
6.2 Membership Subscriptions
Subscriptions renew automatically unless cancelled. You may cancel any time through your account settings. Refunds for partial periods are not provided except as required by Canadian law.
- Intellectual Property
7.1 Platform Content
All logos, graphics, text, and software on AirsoftMarket.ca are the property of AirsoftMarket Inc. or its licensors, protected under Canadian copyright and trademark law.
7.2 User Content
By posting content, you grant AirsoftMarket.ca permission to display and distribute it for the operation and promotion of the Platform. You represent that you own or have rights to everything you post.
- Disclaimers and Limitations
8.1 Platform Disclaimer
AirsoftMarket.ca is provided “as-is.” We make no warranties—express or implied—about:
- Continuous or error-free service.
- Accuracy of listings or user information.
- Quality, safety, legality, or fitness of items listed.
- Conduct or reliability of users.
8.2 Limitation of Liability
To the fullest extent permitted by Canadian law, AirsoftMarket Inc., its directors, officers, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages resulting from your use of the Platform, including disputes or losses arising from transactions between users.
- Dispute Resolution
9.1 Between Users
Disputes between buyers and sellers must be resolved directly between the parties. AirsoftMarket.ca may provide limited support or mediation tools but is not obligated to resolve individual disputes.
9.2 With AirsoftMarket.ca
Any dispute with AirsoftMarket Inc. shall be governed by the laws of Canada and the Province of British Columbia (or your province of residence if required by law). You agree to submit to the exclusive jurisdiction of the courts located in that province.
- Termination
We may suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other misuse. Upon termination, you must cease using the Platform. Certain provisions (intellectual property, disclaimers, limitation of liability) survive termination.
- Modifications to Terms
AirsoftMarket.ca may update these Terms periodically. Material changes will be communicated through the Platform or via email. Continued use after updates constitutes acceptance of the revised Terms.
- Governing Law
These Terms are governed by the laws of Canada and the Province of British Columbia, excluding conflict-of-law principles.
